What is GDPR?

GDPR (General Data Protection Regulation) is a data privacy law created by the European Union. It governs how websites collect, store, and use personal information from visitors.

Even if your business is based in the U.S., GDPR applies to anyone who may receive traffic from users located in the EU. The goal of GDPR is to give users more control over their personal data and how it’s used online.


Cookies are small files stored on a visitor’s device that track user activity, preferences, and interactions.

Under GDPR, websites must:

  • Inform users that cookies are being used.

  • Clearly explain what data is being collected and why.

U.S. States with Privacy Laws

While GDPR is specific to the European Union, several U.S. states have introduced their own data privacy laws that include similar requirements for cookie use and user consent.

These include:

  • California (CCPA / CPRA)

  • Virginia (VCDPA)

  • Colorado (CPA)

  • Connecticut (CTDPA)

  • Utah (UCPA)

These laws generally require that users be informed about what data is collected and given the ability to opt out of tracking or data sharing.

Note: Privacy legislation is rapidly evolving. It’s best practice to include a cookie consent banner for all visitors, regardless of location.
